Please read these Terms of Service carefully before authenticating and using the Prime Ministerโs Wi-Fi Access Network Interface (PM-WANI) public Wi-Fi network. Accessing this network signifies your agreement to comply fully with these provisions.
1. Executive Disclaimer of Liability (Govt. & Provider)
Neither the Government of India, the Department of Telecommunications (DoT), Telecom Regulatory Authority of India (TRAI), nor the local Public Data Office (PDO / Wi-Fi Provider), PDO Aggregator (PDOA), or App Provider shall be held liable under any legal theory for:
- Any loss, destruction, manipulation, or unauthorized theft of data, login credentials, financial information, or personal identifiers while using this network.
- Direct, indirect, incidental, consequential, special, or exemplary damages arising out of network interruptions, signal degradation, line drops, or service outages.
- Damages resulting from malware, ransomware, viruses, cyber-attacks, or unauthorized third-party packet sniffing on this open public access point.
- Financial losses, failed banking transactions, or compromised digital wallets occurring while connected to this Wi-Fi network.
2. As-Is Provision & Service Availability
This public internet access service is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory. Neither the Government nor the Service Provider guarantees that:
- Network access will be continuous, uninterrupted, timely, or error-free.
- Bandwidth speeds will meet specific transmission rates or throughput requirements.
- The network connection will be free from security vulnerabilities or malicious actors.
3. Mandatory Statutory Compliance (IT Act 2000 & Telecom Rules)
Users must strictly adhere to the Information Technology Act, 2000, the Indian Telegraph Act, 1885, the Telecommunications Act, and all associated government rules and regulations. You explicitly agree NOT to use this service to:
- Host, display, upload, modify, publish, transmit, store, update, or share any information that is harmful, harassing, defamatory, obscene, pornographic, pedophilic, or invasive of another's privacy.
- Engage in activity that threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign States, or public order.
- Bypass regulatory restrictions, IP blocks, or transmit unauthorized commercial communications (spam).
- Distribute copyrighted content without legitimate licensing or consent from rights holders.
4. Regulatory Logging & User Data Privacy Policy
In compliance with Department of Telecommunications (DoT) security directives and law enforcement requirements:
- System logs containing your hardware MAC address, assigned local IP address, connection start/end timestamps, duration, and volume of transferred data are automatically generated and stored securely.
- Log data may be inspected by or surrendered to authorized law enforcement agencies, judicial authorities, or intelligence officers upon lawful request without prior notification to the user.
- Mobile phone verification via One-Time Password (OTP) is legally binding proof of identity associated with your session.
5. Open Network & Wireless Security Notice
Public Wi-Fi networks are inherently unencrypted and unsecure over open radio frequencies. Users acknowledge that:
- Transmissions sent across this network may be visible to third parties equipped with packet sniffing tools.
- Users are solely responsible for implementing end-to-end security measures, such as using HTTPS connections, Virtual Private Networks (VPNs), and local software firewalls.
- Connecting sensitive or unencrypted personal, corporate, or banking devices is done at your own risk.
6. Network Management & Fair Usage Policy (FUP)
To ensure fair access to all citizens, the PDO and Network Operator reserve the unconditional right to:
- Limit individual session durations, enforce bandwidth caps, or throttle network speed under Fair Usage Policies (FUP).
- Filter, block, or restrict access to specific protocols, ports, IP addresses, or domains deemed security risks or bandwidth-heavy.
- Automatically disconnect idle sessions or force session re-authentication after specified time limits.
7. Indemnification Clause
You agree to indemnify, defend, and hold harmless the Government of India, the Ministry of Communications, the PDO, its directors, officers, employees, agents, and service partners from and against any and all claims, damages, liabilities, losses, costs, or legal expenses (including legal fees) arising out of or related to:
- Your misuse or unlawful use of this public Wi-Fi network.
- Your breach of any provision contained within these Terms of Service.
- Any violation of third-party intellectual property or privacy rights committed through your connected device.
8. Unsolicited Content & Third-Party Sites
While using the PM-WANI network, you may encounter third-party websites, advertising, or services. Neither the Government nor the Provider endorses, monitors, or assumes responsibility for any third-party content, privacy policies, or practices.
9. Termination of Service Access
The Service Provider and law enforcement authorities reserve the right to immediately terminate or block your access to the network at any time, without prior notice, if suspicious, fraudulent, or malicious traffic patterns are detected from your device.
10. Governing Law & Dispute Jurisdiction
These terms shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India. Any disputes, claims, or legal actions arising under these terms shall fall exclusively within the jurisdiction of the competent courts of India.
